This policy contains the privacy practices in line with Tecnología de Información Convergente, S.A. de C.V., (“TEICO“) with address Blvd. Adolfo Ruíz Cortines #4302 piso 4 Despacho 305-A, Col. Jardines del Pedregal de San Ángel, Alcaldía Xochimilico, C.P. 04500, Ciudad de México. Regarding the website www.teico.com (the “Portal”). This Privacy Policy regulates and informs the people that use the Portal (hereinafter the “Users”) about the treatment provided by TEICO to your Personal Data, as well as a point of contact for the general public and digital marketing professionals for the exercise of their A.R.C.O. rights. For all legal purposes, the terms capitalized in this document that are not expressly defined herein shall have the same meaning as attributed to them in the Federal Law on the Protection of Personal Data Held by Private Parties.

I. Information that TEICO collects in the Portal

TEICO only has access to the information that the User consciously and knowingly provides.

The Portal collects personally identifiable information such as name, address, or email address; however, this information is never gathered without the knowledge and consent of the User in question. Each time TEICO collects information from Users, they are aware of it, as it is done through a form designed for this purpose. At that moment, they are provided with access to this Privacy Policy so that they can accept it and remain duly informed at all times about how their privacy is handled and, in particular, how their Personal Data is processed.

TEICO informs Users that, under no circumstances and for no reason, does it store Sensitive Personal Data on the Portal, as defined in Section VI of Article 3 of the Federal Law on the Protection of Personal Data Held by Private Parties.

TEICO in addition to the information that can be collected to the effect of the Portal, can eventually collect information through an authorized provider that complies with the information security measures established by law via ‘other means,’ which, by way of example but not limitation, may include:

  • Email MKTG campaigns.
  • Affiliation toTEICOs NEWSLETTERs or  BLOGS.
  • Sending email to [email protected].
  • Any other activity involving the processing of personal data for which consent is requested.

II. Use of the information TEICO collects

The Personal Data that the User provides to TEICO, both on the Portal and through any other means, personal data will be processed lawfully and in full compliance with the principles of consent, information, quality, purpose, fairness, proportionality, and accountability, in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties. And with the sole purpose of maintaining the relationship established with TEICO through its client programs, the management, administration, provision, and expansion of the Portal, as well as any other purpose that may be communicated to the User through a privacy notice provided by TEICO, the adaptation of such services to the preferences and tastes of the Users, the study of service usage by the Users, the design of new services related to those already offered by TEICO within the Portal or through Digital Marketing Campaigns, the sending of information regarding service updates, the sending, through traditional and/or electronic means, of technical, operational, and commercial information about products and services currently and in the future offered within the Portal by TEICO.

The User expresses their consent for TEICO to use their Personal Data to send them general information, as well as information of general interest regarding TEICO.

In addition to the purposes already communicated in Part I of this Privacy Policy, we also process your personal data during the use of one of our websites for the following purposes:

  • Manage our users (e.g., registration, account management, answering questions, and providing technical support when available);
  • Measure the use of our website (e.g., through traffic statistics, collecting information about user behavior and the pages they visit);
  • Improve, personalize your experience, and better tailor content to you (e.g., by remembering your selections and preferences, using cookies);
  • Send you personalized services and content based on location;
  • Improve the quality of our products and services and expand our business activities;
  • Monitor and prevent fraud, violations, and other potential misuse of our website and application;
  • Respond to an official request from a public or judicial authority with the necessary authorization;
  • Manage our IT resources, including managing infrastructure and business continuity;
  • Preserve the economic interests of TEICO and ensure compliance and reporting (such as complying with our policies and local legal requirements, taxes and deductions, managing suspected cases of fraud or misconduct, conducting audits, defending litigation);
  • File and maintain records; and
  • Any obligation imposed by competent authorities or applicable laws.

III. Personal Data Protection

For the purposes of the Privacy Policy, Personal Data is understood to be the information that the User provides to TEICO and which Section V of Article 3 of the Federal Law on the Protection of Personal Data Held by Private Parties defines as information concerning an identified or identifiable individual (the “Personal Data”). Users will freely and voluntarily determine whether they wish to provide TEICO with the Personal Data that may be requested or that can be obtained from them through the Portal or by ‘other means’ as defined in this Privacy Policy. Personal Data will be processed and incorporated into the corresponding Databases for which TEICO will be the owner and responsible party. TEICO provides Users with the appropriate technical resources so that, in advance, they can give their consent for TEICO to proceed with the Processing of their Personal Data. Responses to questions regarding Personal Data that may eventually be asked of Users are voluntary, and failure to respond will not affect the quality or quantity of the corresponding benefits, unless otherwise stated. The User guarantees that the Personal Data provided to TEICO is accurate and truthful and is responsible for notifying TEICO of any changes to it. TEICO has adopted security measures for the protection of legally required Personal Data, and will endeavor to implement any other means and additional technical measures within its reach to prevent the loss, misuse, alteration, unauthorized access, or theft of the User’s Personal Data provided to it. The User acknowledges and agrees that TEICO may freely transfer the Personal Data to its subsidiaries, affiliates, and/or authorized providers, who will have the legally required security measures for the protection of Personal Data.

The User acknowledges and agrees that by registering to the Portal http://www.teico.com/ and to the events organized by TEICO, and following the rules that limit its use solely to MKTG Digital Professionals, may receive invitations to Virtual Sessions such as Webinars, Presentations, Round Tables, Continuing Education and Security Awareness Practices, and MKTG Digital, also consenting that for internal auditing and historical record purposes, these sessions may be recorded and stored by TEICO for a maximum period of 5 years. To join the virtual sessions announced on the Portal, by TEICO, or in emails received directly from TEICO, the use of the ‘Connect’ or ‘Register’ buttons will be required to gain access. Furthermore, by using these buttons and registering, the User is understood to consent to the electronic recording (image, video, and audio) of these events.

TEICO legally disclaims any unauthorized recording made by attending users of the virtual sessions organized by TEICO, as well as any misuse they may make of the image, voice, and video of other attendees that does not align with the lawful uses mentioned by TEICO in the previous paragraph.

IV. Rights of Access, Rectification, Cancellation, and Opposition

The Users are recognized and may exercise, at any time, the rights of access, cancellation, rectification, and opposition (‘A.R.C.O.’) by contacting TEICO, through the phone +52 (55) 50259745. Who will in turn channel the request to the person designated by TEICO to handle requests made by Users related to the processing of Personal Data (hereinafter, the ‘Responsible’). The request for access, rectification, cancellation, or opposition must include and accompany the following : (i) The name and address or email address of the Data Subject to communicate the response to their request; (ii) The documents that prove the identity of the Data Subject, or if applicable, the legal representation of the person acting on their behalf; (iii) A clear and precise description of the Personal Data regarding which the Data Subject seeks to exercise any of the rights mentioned above; (iv) Any other element or document that facilitates the location of the Data Subject’s Personal Data; (v) Clearly specify whether the request is for access, rectification, cancellation, or opposition; (vi) The reason for the request; and (vii) The changes to be made in case the request is for the rectification of Personal Data. Once the request is made, TEICO will notify the User, within a maximum period of 20 (twenty) calendar days, starting from the date the request was received, of the determination made. In the event that the request is granted, it will be implemented within 15 (fifteen) calendar days following the date the approval is communicated. This is with the understanding that the aforementioned timeframes may be extended once, if the particularities of the case warrant it, at TEICOs discretion.

If you are not satisfied with the way we handle your personal data, please direct your request to our Data Protection and Privacy Officer, who will investigate your concern. If you are not satisfied with the assistance provided in exercising your rights, you may initiate the ARCO Rights Protection Procedure before the National Institute for Transparency, Access to Information, and Protection of Personal Data (I.N.A.I.), located at Insurgentes Sur No. 3211, Col. V. Use of cookies

Cookies are alphanumeric identifiers that TEICO transfers to the User’s computer hard drive through their web browser to allow its system to recognize the User’s browser and provide personalized features, such as password recognition. The toolbar help in most browsers will inform the User on how to prevent their browser from accepting new cookies, how to set their browser to notify them when they receive a new cookie, or how to completely disable cookies. The data TEICO has access to through cookies are dissociated data, as defined by the Federal Law on Protection of Personal Data Held by Private Parties.

We do not use cookies to track individual visitors or to identify you, but to gain useful insights into how our website and applications are used so that we can continue improving for our users. The personal data generated through cookies are collected in a pseudonymous format and are subject to your right to object to such data processing, as outlined below.

In particular, in addition to the cookies listed in this section, we may also use the following common types of cookies:

  • User interface customization cookies (i.e., cookies that remember your preferences);
  • Authentication cookies (i.e., cookies that allow you to log out and return to our websites without having to re-authenticate);
  • Video player cookies (i.e., cookies that store the data necessary to play video or audio content and store your preferences);
  • First-party analytics cookies (i.e., cookies that remember the pages you visited and provide information about your interaction with those pages); and
  • Third-party analytics cookies (i.e., cookies from external providers that track the statistics of our website and vice versa).

Other Technologies

We may also use other technologies on our websites to collect and process your personal data for the same purposes described above, which include:

Internet tags (such as action tags, 1-pixel GIFs, transparent GIFs, invisible GIFs, and 1×1 GIFs, which are technologies that allow us to track user visits); and

Video-on-demand (VoD) technology, which allows us to quantify the time users watched a video, as well as basic statistical data.

VI. Right to Choose

If the User wishes to stop receiving the information provided by the company, they may request cancellation at any time by simply using the unsubscribe link included in the emails sent to them, or by sending an email to the Responsible Party with the word ‘Remove’ in the subject line and the information detailed in the second paragraph of section 4 of this Privacy Policy, or to contact the phone +52 (55) 50259745.

VII. Collection of Information by Third-Party Sites

The Portal contains links to other sites whose information practices may differ from those of the Portal. Should you visit other sites, it is the User’s responsibility to review the privacy conditions of those sites. TEICO under no circumstances and in no event will the company be responsible for the processing of the User’s Personal Data by sites other than the Portal.

VIII. Legal notice

As stated in the fifth paragraph of section III of this document, TEICO has adopted the legally required security measures for the protection of Personal Data and will seek to implement any other additional technical measures within its reach to prevent the loss, misuse, alteration, unauthorized access, or theft of the User’s Personal Data provided to it. However, due to the fact that security measures may be subject to breaches due to events beyond the company’s control, TEICO, without liability, commits only to inform the User in the event of security breaches, so that the User can take the necessary measures to defend their rights.

TEICO reserves the right to modify this Privacy Policy to adapt it to legislative or jurisprudential developments, as well as industry practices. In such cases, TEICO will announce the changes made on the Portal with reasonable advance notice before they are implemented.
